Sort arbejde

As-salamu 'alaykum wa rahmatullah,

Kan vi ikke få en fatwa om det at modtage betaling for udførelse af sort arbejde, og det at betale nogen for at udføre sort arbejde?

Jazaka Allahu khayr sidi Idris. Vi er mange, som sætter pris på din indsats.
قُلۡ يَـٰٓأَهۡلَ ٱلۡكِتَـٰبِ تَعَالَوۡاْ إِلَىٰ ڪَلِمَةٍ۬ سَوَآءِۭ بَيۡنَنَا وَبَيۡنَكُمۡ أَلَّا نَعۡبُدَ إِلَّا ٱللَّهَ وَلَا نُشۡرِكَ بِهِۦ شَيۡـًٔ۬ا وَلَا يَتَّخِذَ بَعۡضُنَا بَعۡضًا أَرۡبَابً۬ا مِّن دُونِ ٱللَّهِ‌ۚ فَإِن تَوَلَّوۡاْ فَقُولُواْ ٱشۡهَدُواْ بِأَنَّا مُسۡلِمُونَ

Sig: "I Skriftens folk! Kom, lad os enes om et ord, der er fælles for os og jer: At vi tjener Gud alene, at vi ikke sætter noget andet ved Hans side, og at ingen af os tager andre til herrer foruden Gud"! Hvis de så vender sig bort, skal I sige: "Vær I vidner til, at vi overgiver os til Gud!"

Svar fra Mufti Ibrahim Desa'i (Hanafi):

Muslimske borgere, der bor i ikke-muslimske lande, bør overholde de love og regler i deres lande som ikke går imod Islam. En regering er til for at tjene borgerne, og man kan ikke forvente at regeringen skal generere sin egen indkomst. Skat der indsamles fra borgerne er regeringens kilde til at tilbyde borgerne service. Som borgere nyder vi mange faciliteter givet til os fra regeringen, og vi kan ikke forvente at være borgere i et land og ikke deltage i finansieringen af disse af regeringens faciliteter.


Muslim citizens residing in non-Muslim countries should abide by those rules and laws of their countries which are non-un-Islamic. A Government is put in position to serve its citizens. It can not be expected of the Government to generate its own income. The taxes on the citizens serve to provide a financial source for the Government to provide us services. As citizens we enjoy many facilities provided by the Government. We cannot expect to be citizens of a country and not contribute to the facilities and expenses of the Government.



We are living in a non-Muslim country which in governed by its own Constitution. The Government is bound to work within the confines of its constitution and may thus do many things we disagree with due to those issues being un-Islamic. That is another issue and beyond out control. However, that alone is no justification for us not paying taxes.



Paying exhorbitant taxes is a more specific issue than your general question of not paying taxes at all.

Question:
I have become self - employed, and have a contract with one company for one year... I found an accountant, he he states that i will not pay tax for the first year even though others have told me that this sounds dodgy but am not sure that they are right either... The question i guess is that am i allowed to use an accountant and not question his transactions and professionalism in terms of avoiding tax for my benefit. Is my income halal?


Svar fra Mufti M. Adam Kawthari:
In the name of Allah, Most Compassionate, Most Merciful,



Lying and deception are both unlawful and sinful in Shariah, hence it will not be permitted to lie and deceive even to avoid unjust taxes. However, it is permitted to take all lawful means to reduce or even avoid taxes.



The Messenger of Allah (Allah bless him and give him peace) said: "The one who cheats is not of us." (Sahih Muslim, Sunan Tirmidhi, Sunan Abi Dawud and others)



Therefore, what you need to do is to make your position clear to your accountant. Explain to him that you do not want him to lie, cheat and deceive when he manages your accounts. If you are able to trust him in this, then there is nothing wrong in you using his services, as your responsibility would be fulfilled by you making your position clear. However, if you cannot trust his dealings, you should seek another accountant who you are able to trust and who will manage your accounts according to your wishes and requirements.



Your income will remain Halal as long as it is not acquired through any unlawful means, i.e. your job is lawful and the money comes from a Halal source.
